New Jersey Environmental Attorney John M. Scagnelli to Participate in NJDEP Panel Discussions regarding 3rd Party/Spill Act Exempt Parties and Records Request/OPRA Issues.

Scarinci Hollenbeck Partner John M. Scagnelli, Chair of the firm’s Environmental and Land Use Law Group, will participate in two panel discussions at the next meeting of the New Jersey Department of Environmental Protection (NJDEP) Site Remediation Advisory Group (SRAG) Meeting, to be held on December 9, 2015. The topics for the sessions are (1) 3rd Party/Spill Act Exempt Parties, and (2) Records Request/OPRA issues.

At the first session, Third Party/Spill Act Exempt Parties, Mr. Scagnelli and his co-panelists will discuss the differences between remedial obligations at municipally-owned brownfield sites vs. private party remedial sites, including the application of regulations and guidance and lessons learned. The panel will also discuss the applicable statutory innocent purchaser protections and Remedial Action Permit requirements.

At the second session, Records Request/OPRA Issues, Mr. Scagnelli and his co-panelists will discuss Open Public Records Act (OPRA) requests for environmental documents from NJDEP and municipalities and other public entities.
