Scarinci Hollenbeck successfully argued and won a motion for summary judgment in the matter Wilson v. City of Jersey City, et al., a well-publicized wrongful death case involving the stabbing deaths of an adult woman and two of her three children. The plaintiffs (the surviving child and the estates of the murdered children) alleged liability on the part of Jersey City and its 911 operators, emergency dispatcher and the police officers who responded to the 911 call. Our attorneys shielded the City in a case with the potential of a large jury verdict and the Court’s decision granting summary judgment appears to be the first application of an emergency communication worker’s immunity under Title 52, the so-called 911 statute. Scarinci Hollenbeck trial counsel in the case were litigation attorneys Robert E. Levy, Michael A. Cifelli and Laura M. Miller. Mr. Levy supervised the case. Together, he and Mr. Cifelli formulated the legal arguments in support of summary judgment which was decided immediately before the scheduled trial date.
