Scarinci Hollenbeck assists clients in the acquisition, use and maintenance of intellectual property rights, including the selection and registration of trademarks and service marks and copyright protection of material such as literature, computer software and product designs. We regularly counsel clients concerning use of intellectual property rights and deceptive trade practice and false advertising law, and represent numerous clients in the purchase or sale of many types of intellectual property.

We have considerable experience in preparing intellectual property agreements, such as licensing and book publishing agreements. We  also counsel lenders in perfecting security interests in intellectual property.

We prosecute and defend infringement claims and participate in litigation in order to protect intellectual property rights, enforce the confidentiality of trade secrets, contend with unfair competition claims or handle deceptive trade practice and false advertising claims.

We have been involved in the negotiation and formation of joint ventures in a variety of technical areas and regularly provide clients with legal advice and negotiations in connection with all aspects of licensing arrangements. This can include providing advice on the relative value of intellectual property, particularly in the context of license negotiations and acquisition of patents and patent applications. Our intellectual property attorneys work closely with members of the firm's Business Law Group when intellectual property issues are involved in mergers, acquisitions or financings.
