We offer the full spectrum of services, from regulatory compliance counseling and management of environmental liabilities in corporate and financial transactions, to solid waste management and representation in civil, criminal and administrative proceedings.

We understand the impact that certain environmental regulations will have on our clients' operations and have a strong track record of finding effective solutions for the challenging regulatory issues they face. We help our clients achieve and maintain compliance with all federal and state statutes and environmental programs, and we keep sight of new regulations that may impact their businesses down the road. Our work includes designing and implementing company-wide compliance and audit programs, helping businesses obtain permits and land development approvals from regulatory authorities and advising clients on solid waste and/or hazardous waste and substances management. We also work with lenders, investors and buyers to minimize or avoid liability for contaminated real estate.

Scarinci Hollenbeck has helped numerous clients resolve the complex environmental, regulatory and real estate issues associated with brownfields and industrial properties, where redevelopment is complicated by contamination problems. We work with buyers, sellers, lenders, developers and public and private entities and our practice covers the full range of business needs, from complete transactional support and the development of land use-based cleanup strategies through dispute resolution and litigation.

Attorneys in the Group are frequently consulted in connection with environmental issues affecting corporate transactions. Many transactions, from the sale or purchase of real property, to mergers and acquisitions, can introduce environmental risks and liabilities. We structure business, real estate, banking and corporate transactions to minimize environmental risks.

Our attorneys have significant experience in representing clients in environmental lawsuits in federal and state courts and in proceedings before administrative agency tribunals. We are capable of handling a broad range of environmental contamination and toxic tort claims, including remediation and litigation under the Resource Conservation and Recovery Act (RCRA), the Comprehensive Environmental Response, Compensation and Liability Act (CERCLA or Superfund) and the New Jersey Spill Compensation and Control Act. Scarinci Hollenbeck attorneys have extensive experience working with clients in the energy and utilities areas, including independent generation companies, gas and petroleum product pipelines, industrial customers, municipalities, lenders, developers and contractors. Our practice encompasses transactions, permitting and compliance, federal and state regulatory proceedings, energy sector restructuring and deregulation, construction contracting, litigation and legislative policy matters. We have assisted numerous clients in developing and implementing successful and expedient permit strategies for siting, construction and the operation of energy generation, transmission and distribution facilities.

We provide advice and guidance in the area of land use for development and redevelopment within the requirements of local zoning ordinances and by-laws, conservation commissioners and a variety of local, state and federal permitting boards and regulators. We offer a full range of legal services to take our clients through the planning, approval and implementation phases of construction projects of all sizes and varieties. Our clients include developers, private industrial companies, power development companies, educational institutions, retailers and counties and municipalities.
