Robin McMahon has extensive experience in the area of school law and labor and employment law. Ms. McMahon served for more than seven years as in-house counsel to the Newark Board of Education, where she represented the school district in numerous administrative proceedings before the Commission and State Board of Education, Merit System Board, Public Employment Relations Commission, New Jersey Division on Civil Rights, United States Equal Employment Opportunity Commission, and United States Department of Education, Office of Civil Rights. In private practice, Ms. McMahon has represented management in collective negotiations and arbitration hearings and has litigated cases in both State and Federal courts at the trial and appellate levels. Ms. McMahon has been a speaker at conferences co-sponsored by the New Jersey Public Employment Relations Commission and the Labor and Employment Law Section of the New Jersey State Bar Association. She authored the briefs that yielded the landmark decision of Jersey City v. Jersey City Police Officers Benevolence Association, in which the Court, over a contrary Public Employment Relations Commission decision applying the unit work rule, reaffirmed the principle of managerial prerogative and sustained the employer’s reorganization of its police force.
