Matthew Giacobbe specializes in the representation of private and public sector employers. His practice also encompasses school law and municipal law and he represents a number of municipalities and school districts throughout the state of New Jersey. Mr. Giacobbe’s litigation practice includes the representation of management in all areas of employment discrimination, wrongful discharge, wage and hour, whistle-blower claims and restrictive covenant litigation in federal and state courts and before administrative agencies. His labor counseling practice includes representation of public bodies in matters involving contract negotiations, contractual grievance arbitrations, and interest arbitrations. In addition, he counsels both private and public sector employers in areas that include compliance with state and federal employment laws, personnel policy development and employee discipline and termination matters. He won a unanimous Supreme Court decision on behalf of one of his clients, finding that municipal attorneys are not policy makers under 42 USC §1983 and are immune from liability for their actions during trial. The case is Loigman v. Middletown Township, 185 NJ 566 (2006). A frequent author and lecturer, Mr. Giacobbe has written a number of articles on labor and employment law and lectures extensively in all areas of employment law, including on behalf of the New Jersey Institute for Continuing Legal Education. Mr. Giacobbe was named to the 2007 edition of New Jersey Monthly Magazine's "New Jersey Super Lawyers."
